- Memo prepared by the California Public Utilities Commission (CPUC) which summarizes the responsibilities of Federal, State and local governments with respect to the siting of wireless/cellular towers in residential neighborhoods. It was prepared on behalf of State Assembly member Mike Feuer whom we had asked for clarification of the legal ramifications that govern cellphone installations in residential neighborhoods, from the CPUC's point of view. The document is interesting for a number of reasons: Most importantly, it states that "local governments have primary authority to approve tower sites". This contradicts claims made by members of the LA City Council and by representatives of the City Attorney's Office (Ted Jordan) who have maintained, over all the years we have dealt with this issue, that the City has no say over the placement and appearance of cellphone towers in residential neighborhoods and that the whole issue is "a matter of higher authority" (City Councilmember Tom LaBonge). Remarkably, the CPUC memo also mentions an agreement that would allow a moratorium on cell tower sitings in residential neighborhoods of the city. Click here to see memo.
