China Shipping Mitigation Funds
WHEREAS, the Northwest San Pedro Neighborhood Council prepared and
submitted a proposal for the use of China Shipping Mitigation Fund for
aesthetic mitigation to be used to beautify, landscape, and create open
space in two areas in the Northwest Harbor area of the Port of Los Angeles,
and
WHEREAS, this Harbor Beautification proposal was submitted in July
2003 to the Board of Harbor Commissioners and Port Community Advisory
Committee (PCAC) and was subsequently forwarded to the California State
Lands Commission for review, and
WHEREAS, California State Lands Commission reviewed and commented on
the Northwest Harbor Beautification proposal which found that proposed
project provides sufficient nexus between Port operations and consistency
with the Public Trust Doctrine, and
WHEREAS, PCAC has received proposals that show sufficient nexus and
consistency with the Public Trust Doctrine, and
WHEREAS a systematic process and timeline for consideration of consistent
proposals by which an proposal would be reviewed and forwarded for additional
planning and consideration by the PCAC and Board of Harbor Commissioners
has not been established, and
WHEREAS, the current lack of has process and timelines has delayed
mitigating the aesthetic impacts of the Port;
NOW THEREFORE BE IT RESOLVED, the Northwest San Pedro Neighborhood
Council requests the PCAC and Board of Harbor Commissioners implement
a review process for the China Shipping Mitigation Funds that:
1. The process is transparent and open
2. All proposals be reviewed without consideration to cost
3. All acceptable proposals be forwarded expeditiously to the Board
of Harbor Commissioners for its consideration
4. A timeline be established by which mitigation proposals are solicited,
received, and reviewed
5. The Port assigned mitigation coordinator be more effectively utilized
for the solicitation of proposal, review, and follow up
